BABY SQUARE REWARDS PROGRAM

The Baby Square Rewards Program (BSRP) is owned and operated by Baby Square Inc. (“Baby Square”) for clients of the Baby Square's online store at babysquare.ca. The BSRP allows clients to earn Points through the purchase of products from Baby Square and babysquare.ca and redeem earned Points from their Points online.

Rewards Terms & Conditions

The following Terms & Conditions apply to the BSRP. Please visit babysquare.ca to see the benefits available in the BSRP. Baby Square reserves the right to change or modify the benefits from time to time and without notice.

All clients purchasing merchandise at babysquare.ca earn points via the BSRP. Clients must create an online account and/or verify their email address to accept the Terms and Conditions of the BSRP. By doing so, the client has provided consent to the collection and use of personal information for purposes of the program in accordance with our Privacy Policy. In addition, acceptance of these Terms & Conditions entitles the client to redeem earned Baby Square Points, as well as acceptance to receive emails specifically about the BSRP. This includes, but is not limited to, account information, Points earned, Credits Available and Credits Redeemed. The client may choose to unsubscribe from receiving these emails at any time; however, by opting out of the BSRP clients will cease to be able to redeem earned Baby Square Points.

In most circumstances, Points earned will be credited to a member’s account within 24 hours. All purchase will be converted to Points on a one-dollar-one point basis; every 100 points can be eligable to redeem a CA$5 coupon.Baby Square online members will be able to apply their points against the online shopping bill, excluding tax.

Points earned are determined by whether the product purchased is at regular price or a sale or marked down price. These rates are subject to change at the discretion of Baby Square. From time to time, Baby Square may offer promotional points bonus offers (in addition to the base earn) whether to a general audience or targeted to specific clients.

From time to time, Baby Square may audit your account for accuracy and adjust your transaction history, balance to rectify any errors or omissions in Points or Credit accumulation or redemptions.

BSRP specifically reserves the right to terminate the BSRP for any reason upon 60 days’ notice following which you will have 90 days to use your accumulated Credits; Baby Square will have no further liability in respect of any Credits unused after that time. We may change these BSRP Terms & Conditions, or the BSRP, at any time and in any way and will post notice of such changes on our website. We will give you notice by email of any material change of these Terms & Conditions or the features of the BSRP. Your continued participation in the BSRP following any changes in the program or these Terms & Conditions signifies your acceptance of such changes.

In particular, you acknowledge and accept as a Condition of BSRP membership that: BSRP Points have no cash value whatsoever and cannot under any circumstances form the basis of a monetary claim against Baby Square.

Upon presenting/entering a BSRP digital card or valid proof of identify while making a purchase, the Points will be credited to the BSRP account of the member. These Points will be available to be used as part of the redemption criteria, within 24 hours. Any Points reversals on returns, price adjustments, order cancellations and other adjustments will be associated with the transaction record and reversed at the earn rate of the transaction, all within 24 hours.

BSRP membership is limited to natural persons, and no corporation, trust, partnership or other entity may hold membership in the BSRP except as may be authorized by Baby Square at its sole discretion.

Points are not awarded on taxes paid, or for tailoring/alteration charges, purchases of gift cards, freight/shipping/delivery, returns, price adjustments, order cancellations, refunds or exchanges for merchandise of the same value, and are net of customer service adjustments.

BSRP Points and/or any other benefits are personal to the member and cannot be exchanged for cash, assigned, traded, willed or otherwise transferred (other than with the consent of Baby Square and in accordance with these Terms & Conditions), and any assignment or transfer in violation of these rules will be void and may, at the discretion of Baby Square, result in the loss of membership or the cancellation of affected Points.

Baby Square shall not be liable for misdirected or delayed communications such as mail or email, or any consequences thereof.

BSRP members are responsible for keeping up to date on the BSRP, the Points in their account, and their Points earned and used by consulting babysquare.ca. Baby Square shall not be liable for the member’s failure to do so.

Members can withdraw consent to receive BSRP marketing material at any time, by updating their communication preferences profile at babysquare.ca, by unsubscribing from any email or by contacting the Customer Service Team. However, by unsubscribing from BSRP email communications the BSRP member will not receive updates from Baby Square on the BSRP, the Points in their account, their Points earned or used and will not be able to redeem their earned Credits. Members will be able to view their Points accumulated and Credits used at their online account at babysquare.ca.

Members are responsible for any taxes or other governmental charges with respect to Points earned or used.

Baby Square may refuse Points redemptions, reverse Points or Credits redemptions already claimed, or deduct Points from a member’s account where the redemption is based on an error in the Points required for the redemption or an error in the number of Points credited to an account.

Only one BSRP membership is available per customer. Baby Square will, from time to time merge customer files that have all or some matching information (name, telephone, email or mailing address) or at the request of clients, so that customers receive maximum benefit from Points collection. Baby Square will make every effort to contact the customer in the event of a question regarding the merging files.

If Baby Square determines that a member has abused any of the BSRP’s privileges, fails to comply with any of these terms and conditions, or makes any misrepresentation to Baby Square, Baby Square, may, in its sole discretion, take such actions as it deems appropriate, including without limitation, suspending such member’s privileges under the BSRP, revoking any or all of the Points in such member’s account with or without advance notice to the member and without liability to Baby Square.

Any waiver of strict compliance with these Terms & Conditions shall not be deemed a waiver of any other non-compliance, whether preceding or subsequent. If any provision of these Terms & Conditions is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable, that provision will be severed from these Terms & Conditions and the remaining provisions will continue in full force and effect.
